Absentee voting – how NOT to facilitate it

2024 could be the year of straightening out voting rules, if Republicans continue to fight for good rules in court. On Monday (January 8), the Circuit Court of Racine, Wisconsin ruled against a novel form to facilitate absentee voting. Specifically, the court held that mobile voting precincts were not legally authorized, and that if any county or city wanted to use them, the Wisconsin legislature must specifically legislate them. CNAV proposed a mobile voting precinct to handle the “hard cases” of voters who could not vote in person. But the tale in Racine involves abuses that made it no more secure than an unattended drop box. Herewith the details on how the Racine, Wisconsin City Clerk’s office actually used a mobile voting precinct, differs drastically from how a county or municipal clerk or board of elections should use it.

Absentee voting – what’s the problem?

Absentee voting means any way to cast a ballot on behalf of a voter who cannot – or would rather not – appear in person, on the appointed Election Day, to cast a ballot. Unfortunately, in the United States today the usual absentee voting method is to let a voter mail his ballot in. This is an open invitation to fraud – for how is even a good-hearted Officer of Election to know whether the person filling out, signing, and returning an absentee ballot, the same as the person lawfully registered to vote? Signatures are notoriously subject to forgery. Processing large numbers of absentee ballots can delay an election for days, or else must proceed without effective signature verification.

This has caused many activists, concerned for election integrity, to abolish absentee voting altogether. But this creates another problem. Voters find themselves unable to vote in person on Election Day for various reasons. Persons in military service might be deployed elsewhere on Election Day. Business conferences often do not suspend in Election Season. OOEs assigned out-of-precinct either vote early or not at all. And, of course, people fall ill. Unfortunately, some activists’ reply to such hard cases is, “How often does that happen?” Which means “Tough [fornicating] luck!” But “Tough [fornicating] luck” will never stand up in court. Among other reasons for this, the French, which have their own unique method of handling absentee voting, report that seven percent of votes cast use that method. Disenfranchising seven percent of voters can never be acceptable.

The Mobile Voting Precinct

CNAV proposed the Mobile Voting Precinct two years ago. CNAV intended this to address the hard cases without allowing the bedlam that is early or mail-in absentee voting today. To review:

The Mobile Voting Precinct, as CNAV proposed it, was to have the following staff:

  • Driver and driver’s mate, who would have charge of the physical safety of all other staff on the road.

  • Security officer, in charge of physical security at any stop.

  • Sanitation officer, to sanitize equipment against infectious agents.

  • Chief Officer of Election (or Election Judge), who makes final decisions on balloting, provisional ballots, and so on.

  • Assistant Chief Officer of Election (or Election Inspector): an Officer of Election from the opposite Party to the Chief.

  • A number of Officers of Election sufficient to carry out the functions of a precinct. Some of these could function as Security and Sanitation officers. Chief and Assistant Chief could function as driver and driver’s mate.

All personnel for the mobile voting precinct would take an oath of office as Officers of Election. The total staff might be less than the number of positions listed above.

The MVP would carry all the equipment a conventional precinct carries, including voting booths, ballots, scanners, signs, etc.

Dispatching the mobile voting precinct

This vehicle would not dispatch regularly, but only upon specific voter request. It might also dispatch to any institution or installation where one would expect to find many transportation-impaired voters in one place. The obvious candidates include:

  • Long-term care homes. These go by names like “nursing home,” “assisted living community,” and the like.

  • Hospitals. Hospital staff would have one of the priorities for in-person early voting. Hospital patients, however, can’t always plan such things ahead of time. The mobile voting precinct exists to serve them.

  • In-patient physical medicine and rehabilitation centers. The same considerations apply.

In addition, a much smaller version (say, a crossover vehicle), perhaps with driver and driver’s mate (of opposite Parties), could visit a shut-in voter at home. A “mid-sized” version could visit any apartment complex where several voters need the mobile voting precinct to visit them. Voters would pre-apply for this service, instead of applying for mail-in absentee ballots as they do today.

Poll watchers and reporting

Accredited poll watchers would have two choices, depending on the type of dispatch. They could either:

  • Meet the mobile voting precinct at its destination (typically the long-term care home, hospital, rehab, or apartment complex), or

  • Ride around in it, especially if the registrar dispatches it to go door-to-door to voters’ single-family houses.

Today Chief Officers of Election report vote totals after closing. Chief Officers of Election for mobile voting precincts would do the same, and on the same channel: their personal cellphone. Poll watchers would of course stand by, with a copy of the scanner tape. (One other necessary reform might involve including the poll watcher on the reporting call, in conference-call mode.)

How Racine, Wisconsin actually handled absentee voting

But that is not how Racine, Wisconsin used its mobile voting precinct for absentee balloting, according to the challenging lawsuit. According to the Associated Press (via WXIN-TV, Channel 59, Fox Broadcasting Network, Indianapolis, Ind.), Racine officials abused the MVP. Specifically:

The Racine City Clerk sent the MVP to Democratic neighborhoods only, as a regular service. What’s more, they used it to collect ballots, and to take all comers, not those who pre-applied for the service.

According to Jim Hoft at The Gateway Pundit, the MVP never dealt with any Party-accredited poll watchers. That puts the process out of the view of parties interested in the election outcome.

Republicans grew suspicious when they found that the city of Racine ordered a custom-built panel van as an MVP. They paid for it with a $222,045 grant from the Center for Technology and Civic Life. Which is Mark Zuckerberg’s operation – Zuckerbucks!

Ground News gave more information on the improper use of this concept:

The vehicle could be used as an early voting location or voter registration booth in different predetermined locations throughout the year. The purchase for the vehicle was approved in August 2020 for up to $250,000. It is being paid for through the city’s grant from the Center for Tech and Civic Life. CTCL is the nonprofit that received more than $300 million donation from Facebook Founder Mark Zuckerberg.

Again: the Clerk of Elections should dispatch a Mobile Voting Precinct only upon request, to a voter’s home, long-term care home, hospital, or PM&R center. Instead the city was dispatching it to prearranged locations – and not even offering to coordinate with poll watchers.

The court says, no more

Racine County Circuit Judge Eugene Gasiorkiewicz (gah-SYOHR-key-witch) permanently enjoined the use of Racine’s MVP. In his ruling, he said:

Nowhere can this Court find or has been provided any authority allowing the use of a van or vehicle as an alternate absentee voting vehicle.

Just because the law did not specifically disallow an MVP, did not automatically allow it. If Racine or any other Wisconsin city wants to use a Mobile Voting Precinct, let the legislature pass a law. Until then, no. The Wisconsin Elections Commission and Wisconsin Department of Justice won’t say whether they will appeal.

This case came to national attention because Elon Musk, new owner of X, had reason to weigh in on it. A liberal journalist named Judd Legum dropped an angry thread about some of Musk’s recent posts about elections. Specifically, Musk charged that non-citizens were permitted to vote. More accurately, perhaps, the enforcement against non-citizen voting in federal elections is lax. That’s because current case law does not permit a State to demand proof of citizenship for voting in federal elections. So Arizona is issuing “federal-only” ballots. Musk did not mention, but perhaps should have, that this violates the Elections Clause of the Constitution. It is taking “time, place and manner” of electing Senators and Representatives out of State legislative hands.

How else to handle absentee voting?

Needless to say, more than half the replies to Elon Musk’s post above mentioned:

  • The irregularities in the Election of 2020 and how the Democrats profited from them (even if not down-ticket), and

  • Facebook’s complicity therein.

In any event, this exchange has called more attention to the absentee voting problem. Clearly the government of Racine, wishing to stay Democratic, acted in bad faith. How they used their MVP, is equivalent to not running a voting precinct in a Republican area at all. But Republicans must argue in good faith, too. Telling people they get only one shot at voting, and if circumstances do not permit them to vote, “tough [fornicating] luck,” will likely persuade a court to rule for the opposite extreme.

The French, as mentioned, have another solution. Any voter, anticipating a problem with showing up on Election Day, may pre-register, together with someone they trust to vote on their behalf, with a local law-enforcement precinct or municipal court. If a voter is too homebound or bedridden even for that, an LEO or court officer can come to them. A proxy can vote for one other voter. Officers of Election by definition rate special consideration. Any Clerk of Elections should be able to design a system to accommodate OOEs assigned to “foreign” precincts. In theory, the Clerk “knows” the OOEs better than any other voters.

Absentee voting in the military

The military today relies on federal Voting Assistance Officers – who are not always in the military! This is not secure. The best outfits to handle military absentee voting would be the respective uniformed law-enforcement arms of the different services. The only other way to handle military absentee voting is to abolish it altogether. But that evokes memories of the allegations against President Abraham Lincoln about his conduct of the Election of 1864.

The [Lincoln] Administration … had made a doubtful play for the soldier vote, allowing voting only in units where Republican sentiment was strong. Voting by voice made it difficult for soldiers in the field to oppose the general will. On the home front, military units were stationed in areas of strong peace sentiment to discourage Democrats from voting.

Of course modern Democrats dare not complain about that, because Democrats in that election voted as they did from racism. But those interested in election integrity must avoid even the appearance of such manipulation.

Republicans in Wisconsin have two choices in the likely appeal. They can oppose Mobile Voting Precincts altogether, or propose the kind of policies listed here. Or they can examine the French proxy registration system. Present systems operate with no chain of custody – and when 17 percent of voters surveyed admit to fraudulent activities, that becomes unacceptable. Furthermore the sensitivity of the left to Elon Musk’s criticisms of lax election policies signals a clear intent to cheat. Republicans have an imperative to take all necessary measures to prevent this. That demonstrably requires getting control of absentee voting.

Civil war from the left?

The past week, but especially the past twelve hours, has seen some surprising, and concerning, developments on the immigration front. Specifically, the Mayor of Denver, Colorado actually threatened to turn his city into a “fortress of resistance” against the very concept “illegal alien.” His is the most shocking declaration of non-cooperation with the anticipated “mass deportation” by returning President Donald J. Trump. Is the Mayor of Denver putting on a crazy dog-and-pony show? Or is the left preparing to fight a civil war to cling to their last chance at electoral success?

The players in a possible civil war

The American left, and members of it, official and civilian, have not taken the Election of 2024 results well. Ellen DeGeneres and her female intimate partner have already relocated to England. (In doing so, they became the first celebrities to follow through on threats to leave the country if Trump won.)

Celebrities aside, illegal aliens suddenly have many vocal sympathizers. Gov. Katie Hobbs (D-Ariz.) said she will “stand up and protect Arizonans from harm by the federal government.” She seems to count illegal aliens present in Arizona as “Arizonans.” Senator-elect Ruben Gallego (D-Ariz.) charged that Donald Trump’s threatened use of military forces would be “used against American citizens.” He has not made clear what he means by that, if indeed he is doing more than indulging in unfounded speculation.

The President-elect did say on Monday that he will, if he must, declare a national emergency on immigration.

But Border Czar-designate Tom Homan denied that the military, or any other force, would “sweep … neighborhoods” or build vast camps to detain large numbers of people.

They’ll be targeted arrests. We’ll know who we’re going to arrest, where we’re most likely to find ‘em based on numerous, you know, investigative processes.

Retired Deputy Border Patrol Agent J. J. Carrell testified before a House Oversight Subcommittee that President Joe Biden aided and abetted “the largest mass invasion into America the world has ever seen.” Cassandra MacDonald of The Gateway Pundit provided a partial transcript.

On his first day in office, I watched in horror as ninety-four Executive Orders cascaded down from Washington, D.C. obliterating every immigration policy that had provided the most secure border in America’s history. Border Patrol Agents were forced to carry out unconstitutional orders that violated every law in the Immigration and Nationality Act.

By the action of DHS Secretary, Alejandro Mayorkas, President Biden was able to create policy out of thin air, ignoring federal immigration law, and facilitating the largest mass invasion into America that the world has ever seen.
Between one in six and one in seven residents in America is an illegal alien. America has suffered the greatest demographic shift in modern history. The fundamental transformation of America has begun.
I state, with complete certainty, that Biden, Harris, and Mayorkas intentionally, strategically, and purposely weaponized illegal immigration and used it as a tool to fundamentally transform America.

By the numbers

MacDonald quoted Breitbart for more detailed figures:

U.S. Census Bureau data analyzed by the Center for Immigration Studies has found that under Biden and Mayorkas, the foreign-born population has reached an unprecedented 51.6 million as of March of this year.
The rise in the foreign-born population under Biden is equivalent to nearly two years of births in the U.S. and larger than the populations of 33 states.

And no doubt Gov. Hobbs and Senator-elect Gallego want that to continue, on the theory that they’ll vote reliably Democratic. President-elect Trump proposes to remove 10 million, starting with those who, having already broken the law to come to America, committed other crimes in America. They might include Jose Ibarra, who flew into America on one of Joe Biden’s charter flights. A Georgia court yesterday convicted him of rape and murder in the death of Laken Riley, a nursing student in Athens, Georgia, in February of this year. The prosecution asked only for life without the possibility of parole, and the court handed down that sentence.

They might also include an illegal alien arrested yesterday in New York City for robbing one of Manhattan D.A. Alvin Bragg’s assistant prosecutors.

Sen. Rand Paul (R-Ky.) does not agree with using the military to handle deportations. He believes a “domestic police agency” should handle that job. Presumably that would be the uniformed force of the Immigration and Customs Enforcement (ICE) agency. He estimated that only 28,000 illegal aliens have committed crimes in-country beyond the crime of unlawful entry.

Gov. Greg Abbott (R-Texas) has offered a 1400-acre tract of farmland in Starr County, Texas, for building a detention compound. He instructed Texas Land Commissioner Dawn Buckingham to write to President-elect Trump to convey that offer. Border Czar-designate Homan told Laura Ingraham yesterday that the Second Trump administration will accept that gift.

A fortress of resistance?

With 1400 acres for a detention facility, the mass deportation operation wouldn’t need detention facilities in any “blue” States. (“Red” States would cooperate far more readily.) But one “blue State” mayor has actually vowed to oppose the deportations – on a level of physical violence.

Mayor Mike Johnston (D-Denver, Colo.), in an interview with a local outlet, said he would use “city police and local volunteers” to block any attempt to arrest, detain, or transport illegal aliens out of his city or the State of Colorado. All that Trump had said was that he would defund any “sanctuary city.” But Mayor Johnston raised the stakes. He began by confidently asserting that Gov. Jared Polis (D-Colo.) would not let Trump call on the Colorado National Guard.

Unless they were planning on bringing national guards mobilized from Texas or Alabama to come invade Colorado, I don’t know where they would find the forces to begin to do that. And that seems to me like a very, very bad idea from start to finish that no reasonable American would support.

Did he just, a priori, call the family of Laken Riley “unreasonable”? But then he said worse:

More than us having DPD stationed at the county line to keep them out, you would have 50,000 Denverites there. It’s like the Tiananmen Square moment with the rose and the gun, right? You’d have every one of those Highland moms who came out for the migrants. And you do not want to mess with them.

The problem is that everyone knows that Denver is home to several Venezuelan gangsters. George Behizy isn’t at all sure that the Denver Police would obey orders to protect that sort of person.

Anyone else game for civil war?

Apparently Mayor Johnston isn’t entirely alone in posturing for civil war against the Second Trump Administration. Gov. J. B. Pritzker (D-Ill.) said something similar, but far less detailed:

If you come for my people, you come through me.

Border Czar-designate Homan replied, in an interview with Turning Point’s Charlie Kirk:

Game on. We’ve got no problem going through him.

And in greater detail:

I’ve got 20,000 men and women in ICE who are going to do their job with no apology. Congress has enacted a law that protects this country. People need to understand… entering this country illegally is a crime. Every illegal alien in this country committed a crime to get here. So they’re all criminals.
And look, there’s some worse than others, I get that. And even if they’re not a criminal alien, when you cross that border and you overwhelm the border patrol… that’s when the fentanyl comes across to kill a quarter-million people. That’s when you have a 600% increase in sex trafficking. That’s when you have a record number of terrorists crossing the border. Illegal immigration is not a victimless crime.
We’re gonna enforce the law without apology… and if any governor wants to stand in the way, go ahead and do it. We’ll see what happens. We’re not gonna be intimidated.

Gov. Pritzker – and Gov. Polis, and Mayor Johnston – might want to consider something else. Vice-President Kamala Harris carried both States with 54 percent of the vote – and that vote does not evenly distribute itself. Chicago is an island of blue in a sea of red – and Chicago residents are getting fed up with illegal aliens themselves. Denver is another island of blue in a sea of red. Texas National Guardsmen could cross the Oklahoma Panhandle – in House District 3, where Rep. Frank Lucas (R-Okla.) ran unopposed for reelection – and enter Colorado in Rep. Lauren Boebert’s (R-Colo.) new District, which she won with 54 percent of the vote. Alabama National Guardsmen could land at DFW, or AMA (Rick Husband Amarillo International Airport) and stage from there. To say nothing of Unauthorized Colorado, Oklahoma, and/or Texas Militias.

Does the Mayor of Denver really think he can withstand siege in a leftist civil war? If so, it would indeed be “game on.” No doubt the irony that he, a leftist, and not President-elect Trump or any of his allies, called for civil war first, is lost on Mayor Johnston. And contrary to his opinion, the support would be on Trump’s side, not his.

The Trump Effect

Fifteen days have passed since the Election of 2024 made Donald J. Trump a President-elect once again. Those fifteen days have seen a demonstration of a profound effect – not quite universal, but still salutary – on public affairs. Call it the Trump Effect. This goes beyond the shocking series of unforced errors that not only let Trump win reelection, but also cost Democrats control of the Senate and stopped them from regaining control of the House of Representatives. Corrupt prosecutors, vindictive establishment politicians, and slanderous “journalists” are folding their tents in ways no one would have predicted. Rather than brazenly continuing their warfare, most of them are surrendering. Those who have not surrendered, have found friends and supervisors abandoning them. If the Trump Effect is real, it is the most stunning change-of-power in Western political history.

The Trump Effect turns off the lawfare

Recall that, as the election approached, Donald Trump had a conviction on his record, on an absurd thirty-four counts. Many have observed, despite the hectoring pontification of the prosecutor in that case, that no businessman except Donald Trump had ever faced such charges under the circumstances involved, or ever would face them. Still, Trump was facing sentencing in that case.

Tellingly, the judge in that case had postponed sentencing until after the election. This was the second such delay; earlier the judge had delayed sentencing from July 11 to September 18. That delay followed the U.S. Supreme Court’s Primer on Presidential Immunity.

Now that Trump has won reelection, Judge Juan Merchan has delayed sentencing indefinitely. He gave no explanation.

Nor is this all. The Department of Justice, and the Office of Special Counsel, have asked Judge Tanya S. Chutkan to vacate all briefing deadlines in their “January 6 case” against Trump. Furthermore, Special Counsel Jack Smith has asked the Eleventh Circuit Court of Appeals to vacate deadlines in his appeal of Judge Aileen M. Cannon’s dismissal of the “Documents Case.” In fact they were evaluating filing motions-to-dismiss on all cases the day after the election. Smith and Attorney General Merrick Garland say that “longstanding policy” against prosecuting sitting Presidents requires this action.

But they might have other motives. Texas Attorney General Ken Paxton has sued the Department, after first demanding preservation of records. And now Department officials – and officials at the FBI – are hiring criminal defense attorneys.

Drama surrounding nominees

Last week, of course, Donald Trump announced his first round of nominees for Cabinet and other offices. They included Rep. Matt Gaetz (R-Fla.) as Attorney General, and Robert F. Kennedy, Jr. as Secretary of Health and Human Services. (Rep. Gaetz resigned from the House the next day. He sought to start the clock on a special election to succeed him in Congress, and thwart the release of some damaging information.) Both men have faced, and continue to face, serious attacks by those they threaten. Lee Fang today described the campaign by the junk food industry to vilify Kennedy. But two days ago, Sen. Cory Booker (D-N.J.) sounded the same alarms Kennedy is sounding, about American food.

For years I have been raising the alarm of the dangers of our current food system. We’re prioritizing corporations feeding us unhealthy products instead of family farmers growing fresh, healthy foods - and we let too many dangerous chemicals flood our food system. We all must come together to build a system that works for all.

That suggests Kennedy might have significant Democratic support in the Senate.

Matt Gaetz benefits from the Trump Effect

Matt Gaetz will have worse confirmation problems – or will he? True, thirty nominally Republican Senators, including Sens. Lisa Murkowski (R-Alaska) and Susan Collins (R-Maine), said, “No.” Worse, the House Ethics Committee surreptitiously released some information they thought would damage Gaetz. The information concerned allegations that he had been in appropriate with a girl, then 17 years old. Gaetz has consistently denied that anything of the sort occurred. Furthermore, the Justice Department declined to prosecute, in fear that their star witness would crack up on the stand. Nevertheless two other witnesses have their own attorney, who started hinting that he would keep those allegations alive.

But yesterday morning, Trump started calling Senators personally to urge their support for Gaetz. And before the day was out, the attack campaign against Gaetz started to unravel. Sunny Hostin, co-hostess on ABC’s The View, choked back her rage as she read aloud a disclaimer on the allegations. Today, Sen. Lindsey Graham (R-S.C.) publicly declared his support of Gaetz and told his fellow Republicans to knock it off. And by day’s end, the House Ethics Committee had voted against releasing any more information. But Rep. Sean Casten (D-Ill.) threatened to blast the report out of that Committee with a privileged discharge motion. Nevertheless, one of those very witnesses now says Matt Gaetz will make a great Attorney General!

Behold the Trump Effect. Nothing else could explain what just happened in that Committee, or Sen. Graham’s change of attitude.

The Trump Effect on journalists

Sunny Hostin’s rage-choked reading of the disclaimer is only one example of the Trump Effect on journalists. Recall that MSNBC’s Mika Brzezinski, and her husband Joe Scarborough, both have compared Trump to Hitler. In fact, Mika ranted and raved on the subject of Trump less than two weeks before the Election.

But over the weekend, the two met with Trump at his Mar-A-Lago club and estate. After that they said they’d take “a new approach” to their coverage of Trump. They likely did so on orders from Comcast executives, who are trying to sell MSNBC. (So far, they have no takers.) Megyn Kelly is not impressed, and the hostesses of The View are outraged.

Shortly before the Election, Ann Selzer of The Des Moines Register published a poll saying Vice-President Kamala Harris was leading Trump by 3 percent in Iowa. In fact, Trump carried Iowa by 13 percent. This caused great embarrassment for Ms. Selzer, who evidently couldn’t read her own crosstabs! She has since quit polling.

On election integrity and immigration

Not only did Trump carry Pennsylvania, but Republican David McCormick took the seat of Sen. Robert Casey (D-Pa.). After that, at least one Board of Election voted at least 2-1 to count mail-in absentee ballots lacking proper dates, signatures, or both. The Pennsylvania Supreme Court had already ruled such ballots illegal – but the Bucks County Board counted them anyway. One member, Diane-Ellis Marseglia, boasted of it.

We all know that precedent by a court doesn’t matter anymore in this country. And people violate laws anytime they want. So, for me, if I violate this law, it’s because I want a court to pay attention to it.

The Pennsylvania Republican Party sued, and the Pennsylvania Supreme Court ordered the Board to stop the illegal counts and remove any illegally counted ballots from the vote totals. After that, Ms. Meseglia claimed others took her remarks out of context. Activist Scott Pressler, who had gallivanted across the State registering new Republicans to vote, today led a group of protesters into the Board of Elections meeting. They demanded the immediate resignation of Meseglia and her fellow Democrats.

And on immigration, the Haitians are running out of Springfield, Ohio, as fast as they can run. They’re not waiting for the coming mass deportation! In fact, Trump said he would declare a national emergency, so he could use the military to deport people. Leftist officials, like Gov. Katie Hobbs (D-Ariz.), refuse to cooperate. No matter, it seems. Gov. Greg Abbott (R-Texas) has offered 1400 acres on the Rio Grande Valley for building a deportation facility. Behold the Trump Effect writ large.

Summary

The Trump Effect is real, and apparently pervasive, at least for domestic issues. Donald Trump’s legal troubles seem to be over – and he has a strong jurist who will make an excellent appellate judge, and possibly a Justice of the Supreme Court, someday. He’ll get his nominees, no matter the controversy surrounding them, because he has momentum on his side. Journalists have effectively surrendered, clearly indicating that all their vituperative name-calling of Trump and his supporters was worse than exaggerated.

Stopping the illegal counting of faulty mail-in absentee ballots in Pennsylvania was a good start. (It should end in removal of those election commissioners from office, and eventually the abolition of voting by mail.) And Gov. Abbott’s offer of land to build a deportation facility will do more than solve the illegal immigration problem. This will dampen the enthusiasm in Texas for seceding from the Union. Doubtless the Texas Nationalist Movement will keep campaigning for that. They should – that’s how they will obtain a full redress of the many grievances the Biden-Harris administration has provoked. But one of the first moves new Attorney General Matt Gaetz should make, is to dismiss the cases his predecessor filed against Texas, and settle the cases Texas filed against the federal government.

Trump hasn’t even taken office, and already he has brought salutary change to America. He’ll bring even more such change when he assumes office.

Abortion is not a winning stance

In the campaign for the Election of 2024, abortion was the signature issue on the American left. Democratic candidates, from Vice-President Kamala Harris down, campaigned on the specter of a hypothetical federal law banning abortion nationwide. No Senator or Representative has introduced any such law. They would be far more likely to introduce a joint resolution for a Human Life Amendment, but they won’t introduce that until Republicans command two-thirds of both chambers of Congress. But results in the Presidential race, several down-ticket races, and ten public questions throughout the land show that abortion is no longer the winning issue it once was for the left. Failure to realize that will cost people on the right – as it arguably did in Arizona. More to the point, abortion is a generational issue, by its very nature – and time is on the pro-life side.

How abortion fared in public questions

The closest to a neutral source on the outcomes of office races or public questions is Ballotpedia. They exist to provide the bare facts: which candidate, or side of a public question, won or lost? The devil is in the details

Notice! Nebraska offered voters a direct choice: prohibit abortions after the first trimester (roughly 15 weeks), or allow it “until fetal viability.” Nebraskans voted yes to forbid and no to allow. Similarly, voters in Florida and South Dakota defeated Constitutional amendments to allow the procedure before viability.

Colorado and Maryland each passed abortion on demand, or something close to it. New York passed a measure, the effect of which is next to impossible to determine. Arizona, Missouri, Montana, and Nevada passed bills allowing the procedure with regulations allowed after fetal viability.

“Viability” is already a standard that will reduce the “allowed” period as obstetrical science continues to advance. (Chief Justice John Roberts had hoped someone would “brief” the Supreme Court to show that viability obtained at 15 weeks.)

The abortion law interactive map, as of November 6, showed that Arizona and Missouri constituted net losses for life. Laws in the other States named, remained as they were before the election. But Arkansas, though it took no action, finds an “abortion tourist trap” State on its border for the first time.

Three key Senate races

Pro-life Press highlighted the outcomes of three Senate races, in Pennsylvania, Arizona and Maryland. The losing candidates in each made moves to embrace more protections for abortion. Senator Robert P. Casey, Jr. (D-Pa.) tacked hard toward abortion, after representing himself as pro-life earlier. Senate candidate Kari Lake in Arizona publicly disagreed with an Arizona Supreme Court decision saying that a “trigger law” came properly into force and effect after the U.S. Supreme Court’s seminal ruling. (Dobbs v. Jackson Women’s Health Organization, 2022.) And former Gov. Larry Hogan (R-Md.) lost his own Senate race after claiming he was “the only Republican who can win” in Maryland.

No doubt the Arizona abortion question passed to nullify its Supreme Court decision. Perhaps no Maryland Democrat will ever trust a Republican. But Kari Lake had a winnable race, and threw it away. (This confirms YouTube influencer Brandon Tatum’s impression that Kari Lake is simply not a strong candidate. She lost, though Trump won and not one Arizona House Republican lost his seat. Tatum didn’t seem to know exactly why she lost. Maybe this is why.)

In contrast, consistent advocacy for abortion on demand did not help Vice-President Harris. She still lost – not only in the Electoral College but in the popular vote.

Some damning statistics on abortion

Pro-life Press also highlighted a report from the Centers for Disease Control and Prevention (CDC) about why abortions happen. This report also had statistics from the Charlote Lozier Institute’s examination of statistics from eight States that keep adequate records. According to it, more than 95 percent of all abortions are elective. The other “indications” (a fancy medical term), in order from the rarest to the most common, were:

  • Risk to the life, or a major bodily function, of the mother: 0.2 percent.

  • Rape or incest: 0.3 percent.

  • Abnormality in the unborn child: 1.3 percent.

  • Physical health concern, not elsewhere classified/not otherwise specified: 2.5 percent.

The CDC said: 58% of women had their first abortion, 24% their second, 10% their third, and 8% four or more. Most likely, these women are having the procedure for birth control – so they are more likely to have no children.

And some of these women are vitriolic in their opposition to the idea of childbirth. The results of this last election did not satisfy them, particularly with Kamala Harris losing. A certain woman calling herself “your #1 misandrist” (man-hater) posted this on X:

Ladies, we need to start considering the 4B movement like the women in South Korea and give America a severely sharp birth rate decline:
- no marriage
- no childbirth
- no dating men
- no sex with men

In Korean, the word pronounced bi means no, hence the name of the movement: the Four Noes. Reaction to the post is mixed at best.

Whose side is time on?

What many commentators on both sides are still missing, is that time is on the pro-life side. Leftists like to assume that their ideas will always gain ever greater currency, as children demand ever greater personal license. But they forget the same thing Gilbert and Sullivan’s fictitious Princess Ida forgot:

If you enlist all women in your cause, / and make them all abjure tyrannic man, / the obvious question then arises: How / is this posterity to be provided?

So when the “#1 Misandrist” calls for “a severely sharp birth decline,” she condemns her own side to demographic winter. Meanwhile, women on the right will continue to have children – and those committing themselves more to marriage and family will have more of them. Even in the worst case, the Old Order Amish, the most family-oriented sub-group in America today, will “inherit the Earth.” Already they number 400,000, having doubled in the last 25 years and spread from Pennsylvania to Ohio and Indiana. An Amish woman will have, on average, at least four children in her lifetime, and usually six or seven! With such a high Total Fertility Rate, no wonder their population doubled in a generation! Remember: the replacement level for Total Fertility Rate is 2.1. (Considering the atrocious state of the abortion debate in Canada, the Amish might likely “invade” and take them over first. The Canadians are considering euthanasia for babies. Canada’s population “grows” by immigration only.)

So time is on the side of life, as the Death Culture celebrates death and condemns itself to it. Candidates should remember that, and ignore the demands of a political sub-group bent on suicide by attrition.
